                                           MINUTES OF THE SPECIAL MEETING
 
                                             WEDNESDAY, SEPTEMBER 24, 2008
 
                                                                      4:30 P.M.
 
The Board of County Commissioners of Madison County, Florida met this day in Special Session with the following members present: Ricky Henderson (District 1), Wayne Vickers (District 2), Ronnie Moore (District 3), Alfred Martin (District 4), and Roy Ellis (District 5). Also present were County Coordinator Allen Cherry, County Attorney George T. Reeves, and County Clerk Tim Sanders.
 
The Chairman, Honorable Alfred Martin, called the Special Meeting to order and explained the purpose was to consider the purchase of the building and property adjoining the Courthouse Annex extending from Pinckney Street to Rutledge Street in the City Of Madison.
 
Mr. Cherry reported on the meeting with the property owners, Albert “Geno” and Cindy Poire, along with the Clerk regarding said purchase. He stated the Poires offered to sell the property for no less than $525,000 and an equal split of the closing costs estimated at $7,000. Mr. Cherry added the Poire’s original offer to sell was $650,000.
 
The County Attorney presented and reviewed a proposed CONTRACT FOR SALE to the Board for their review between the County and the Poires with the sum of the purchase price left blank. He also advised Florida Statutes require a super-majority vote by the Board when the purchase price of real property exceeds an appraisal. He also advised the Board has the right of Eminent Domain, but this very expensive process does not guarantee a cheaper purchase price.
 
            Discussion followed regarding the necessity to provide an office in the courthouse for a new Circuit Judge and a new temporary location for the Sheriff’s administrative offices. Also the fact that the adjoining property to the Annex was more valuable to the county than anyone else was discussed.
 
            A motion was made by Commissioner Henderson and seconded by Commissioner Vickers to approve the aforementioned CONTRACT FOR SALE with a purchase price of $525,000 and an equal split of closing costs. Motion carried unanimously (5-0).
 
            Mr. Sanders asked the Board for permission to utilize the architectural services of Clemons, Rutherford and Associates to prepare drawings for the new judge’s and sheriff’s offices, since Clemons, Rutherford is the architect for the present courthouse improvement project and due to the fact that the new circuit judge will need office space in mid-January, 2009. A motion was made by Commissioner Moore and seconded by Commissioner Vickers to approve the Clerk’s request, subject to review by the County Attorney. Motion carried 5-0. 
 
There being no further business, Chairman Martin adjourned the meeting at 4:50 P.M.
