MINUTES OF THE SPECIAL MEETING
 
TUESDAY, APRIL 13, 2010
 
6:00 P.M.
           
The Board of County Commissioners of Madison County, Florida met this day in Special Session with the following members present: Justin Hamrick (District 1), Wayne Vickers (District 2), Renetta Parrish (District 3), and Roy Ellis (District 5). Also present were County Coordinator Allen Cherry, County Attorney George T. Reeves, and County Clerk Tim Sanders. District 4 Commissioner Alfred Martin was not present due to a conflict with the City of Madison Commission Meeting.
 
The Chairman, Honorable Justin Hamrick, called the meeting to order and explained the purpose of the meeting was the consideration of agreement for cost sharing of expenses related to the groundwater monitoring around the old Madison County Landfill.
 
County Attorney Reeves explained the current SETTLEMENT AGREEMENT between ITT THOMPSON INDUSTRIES, INC. AND ITT INDUSTRIES, INC. and MADISON COUNTY, FLORIDA and the CITY OF MADISON, FLORIDA, regarding the responsibility of the City and County for operation and maintenance (“O&M”) expenses relating to the remedial system in operation at the former Madison County Landfill and the credit balance received by ITT for the construction of said remedial system.
 
            Mr. Reeves also presented to the Board an AMENDED SETTLEMENT AGREEMENT between the same entities that addressed the immediate full operational requirements of the remedial system to secure information for a complete “5-year review” of the system’s effectiveness, which is due to be issued by the United States Environmental Protection Agency (EPA) in September of this year. He stated the new costs to upgrade the system are a one-time expense for said EPA review and are not O&M and will be divided three ways, 60%-ITT; 20%-County; 20%-City.
 
            Madison County’s Landfill Engineer Frank Darabi reported this review by EPA is the third of its kind and because he works for the County, he wanted the Board to be fully aware of the costs to upgrade the system before proceeding. Mr. Darabi presented a paper entitled Madison County-ITT Thompson Super Fund Site Tasks and Cost Estimate To Respond to EPA 5 Year Review Comments. The Total Cost is $138,328.00 with Cost Sharing as per Revised Agreement:
                        ITT Thompson            @60%             $82,996.80
                        Madison County         @20%             $27,665.60
                        City of Madison          @20%             $27,665.60
           
Mr. Darabi also presented his fee estimate as part of said costs for additional services to assist in said EPA response in the amount of $60,878.00. Attention was directed to Section 4 of said AMENDED SETTLEMENT AGREEMENT and Mr. Darabi stated the $40,000 figure should be changed to $61,000.
 
            Commissioner Martin arrived at the meeting from the City of Madison Commission Meeting at 6:15 P.M.
 
            After further discussion, a motion was made by Commissioner Ellis and seconded by Commissioner Vickers to approve said AMENDED SETTLEMENT AGREEMENT, subject to the aforementioned change in Section 4 (replace $40,000 with $61,000). Motion carried unanimously (5-0).
 
There being no further business, the Chairman adjourned the meeting at 6:30 P.M.
